EXPLORER ZONE TERMS AND CONDITIONS

1. Access & Eligibility

Access to the Bush & Beyond Explorer Zone is granted exclusively to approved, registered trade partners. Approval is at the sole discretion of Bush & Beyond.

Login credentials are strictly non-transferable and must not be shared with third parties. Access remains conditional and may be revoked at any time, without notice, where misuse or breach of these terms is identified.

2. Confidentiality of Rates

The Explorer Zone provides access to publicly available rack rates and confidential discounted agent rates.

• Rack rates are public and may be quoted online.
• Discounted agent rates are strictly confidential and non-public.
• Commission levels and agent discounts must not be disclosed to clients or third parties.
• Redistribution of rate sheets or commercial documentation to third parties is prohibited.

While Bush & Beyond cannot control how trade partners structure their client pricing, partners are strongly requested to quote rack rates to clients. Any discount applied represents the agent’s commercial margin. Agents may apply mark-ups above rack rates at their discretion but should note that rack rates are publicly available.

All rates must be reconfirmed at the time of quotation. Published rate sheets, whether issued by Bush & Beyond or third-party properties, are static documents and subject to change.

3. Use of Media & Marketing Materials

Images, videos and downloadable resources within the Explorer Zone are provided exclusively for the promotion and sale of Bush & Beyond properties and the individual properties represented within the portfolio.

Media may only be used in direct association with the relevant property and may not be used for the general promotion of Kenya, safari travel or unrelated destinations.

3.1 Edited Property Films

Edited property films are final branded assets and must be used in their original form.

• Films may not be edited, cropped, shortened, re-cut or altered in any way.
• Music, voiceover, logos and branding elements must not be removed or replaced.
• Films must be credited clearly to the relevant property.
• For social media use, the property’s official handle must be tagged and mentioned.
• Films may not be used in paid advertising (including Google Ads, Meta Ads, boosted posts or sponsored placements) without prior written approval.

These films represent completed creative work and must be presented as supplied.

3.2 Video Clip Library

The video clip library is provided for the creation of property-specific social and promotional content.

Approved partners may:

• Shorten clips
• Combine multiple clips
• Add captions or light formatting adjustments

The following conditions apply:

• Clips must remain directly associated with the relevant property.
• The property must be clearly credited and tagged where applicable.
• Clips may not be used for general destination marketing.
• Clips may not be used in paid advertising without prior written approval.
• Clips may not be supplied, transferred or redistributed to third parties.

3.3 Image Usage

• Images may be resized but must not be materially altered.
• Images must be credited to the property and photographer where specified.
• Images may not be used in paid advertising without prior written approval.
• Images may not be used for generic destination promotion or to promote competing properties.

3.4 General Media Restrictions

• Media may not be supplied, sublicensed, transferred or distributed to third parties.
• Media may not be used for AI training, machine learning datasets, resale or stock library redistribution.
• Bush & Beyond logos may not be used without written consent.
• Copy, maps and layouts may not be modified without prior written approval.
• Rebranding of itineraries or documents is permitted only upon written request and approval.

Bush & Beyond reserves the right to withdraw permission for use of any media asset at any time.

4. Proper Use of Resources

All resources within the Explorer Zone are intended solely to support the promotion and sale of Bush & Beyond properties.

Materials may not be:

• Shared with third parties
• Used to promote competing properties
• Stored or redistributed outside approved commercial use

Bush & Beyond reserves the right to withdraw or amend materials at any time.

5. Amendments & Accuracy

While every effort is made to ensure accuracy, Bush & Beyond does not guarantee that materials, rates or information remain current at all times.

All rates must be reconfirmed at the time of quotation.

Bush & Beyond reserves the right to amend rates, policies, materials or these terms without prior notice.

6. Termination

Bush & Beyond reserves the right to suspend or permanently terminate Explorer Zone access immediately, without prior notice, in the event of:

• Breach of confidentiality
• Misuse of rates or media
• Unauthorised distribution of materials
• Misrepresentation of pricing or commission structures
• Breach of these Terms & Conditions

7. Governing Law

These Terms & Conditions are governed by the laws of Kenya. Any disputes arising in connection with the Explorer Zone shall be subject to the exclusive jurisdiction of the courts of Kenya.
